The Police
Q: The police want to come to my home and ask me questions......
Q: The police want to come to my home and take a statement.......
Q: The police want me to come down to the station and give a statement.......
Q: The police want to talk to me on the phone.......
Q: The police want me to give a statement over the phone......
SHOULD I TALK TO THEM???
A: The answer in all of the above situations is the same, never talk to the police without talking to your lawyer first. Discuss the situation with your lawyer BEFORE you talk to the police.
Explain to the police that you will talk to your lawyer and someone will get back to them. An honest officer will understand and be willing to wait until you talk to your lawyer.
IF the police have a warrant, then they have a right to enter your home. IF you don't let them in, they will bust down the door. However, if they are "asking" your permission to "come in" and talk or search, the answer is ALWAYS "NO."
Q: May we come in and search? A: NO.
Q: May we come in and talk? A: NO.
Q: We don't want to stand outside, the neighbors will see that you are talking to the police.
A: [Would you rather have the neighbors see you letting the police into your home and you walking out in handcuffs moments later?]
Remember: you can listen to their questions while they stand on the front steps, but your answer should always be the same.
A: Officer, I have nothing to say to you, until AFTER I talk to my lawyer.
Most insurance agents have a packet of instructions telling you what to do [get a packet BEFORE you have an accident] BUT at a minimum:
1. IF someone may be injured, call EMS at 911.
2. IF the cars cannot be moved, call the police at 911.
3. IF the damage is minor and no one is hurt or bleeding, contact the police at 911. Follow their instructions.
