A man is alone in his own home and police are called for a disturbance. Can the police bust in and arrest the man and then charge him with resisting arrest? Those are the basic facts in this case that Mr. Price took as an appeal to the Second District Court of Appeal.
C.U. v. SOF
Can a teen go along for the ride and then decide what is happening is wrong and flee but still be prosecuted. When does running mean you have abandoned the crime. Before it starts, at the beginning, in the middle, just past the middle but never at two-thirds? Does prior record count? Does a first offender get more chances or less. This case is pending before the Second District Court of Appeal right now.
